End User License Agreement

This End User License Agreement ("Agreement") governs your use of the Smart Aisle Menu software application ("App") provided by Smart Aisle Menu ("Licensor"). By downloading, installing, accessing, or using the App, you agree to be bound by the terms of this Agreement. If you do not agree to these terms, do not download, install, or use the App.
1. Apple EULA Incorporation
This App is licensed to you under the terms of the Apple Standard EULA, available at apple.com/legal/internet-services/itunes/dev/stdeula. The terms of the Apple Standard EULA are incorporated herein by reference and apply to your use of the App. In the event of any conflict between this Agreement and the Apple Standard EULA, the Apple Standard EULA shall prevail with respect to matters relating to the App Store and Apple's platforms.
2. License Grant
Subject to your compliance with the terms of this Agreement and the Apple Standard EULA, Licensor grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on Apple-branded devices that you own or control, solely for your personal, non-commercial use. You may not copy, modify, distribute, sell, lease, lend, or create derivative works of the App except as expressly permitted by the Apple Standard EULA and applicable law.
3. Use of the App
Smart Aisle Menu generates meal plans and shopping lists based on publicly available Aldi weekly ad data and estimated pricing. The App does not guarantee the accuracy, completeness, or timeliness of any pricing, nutritional, or product information displayed. Prices shown are estimates and may vary by store and region. You are responsible for verifying all prices and product availability in store before making any purchase. The App is an independent tool and is not affiliated with, endorsed by, or sponsored by Aldi.
4. No Warranty
The App is provided "AS IS" and "AS AVAILABLE," without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. Licensor does not warrant that the App will be uninterrupted, error-free, or that defects will be corrected. To the maximum extent permitted by applicable law, Licensor disclaims all warranties. This section does not affect any rights you may have under the Apple Standard EULA or applicable consumer protection laws that cannot be waived by contract.
5. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Licensor be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of or inability to use the App, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if Licensor has been advised of the possibility of such damages. Licensor's total liability for any claim arising out of this Agreement shall not exceed the amount you paid for the App, if any. Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.
6. Privacy
Your use of the App is also governed by the Smart Aisle Menu Privacy Policy, available at our Privacy Policy page. The Privacy Policy describes how we collect, use, and protect your information when you use the App.
7. Compliance with Laws
You agree to use the App in compliance with all applicable local, state, national, and international laws and regulations. You are responsible for ensuring that your use of the App complies with any laws applicable in your jurisdiction.
8. Termination
This Agreement is effective until terminated. Licensor may terminate this Agreement at any time, with or without cause. Upon termination, you must cease all use of the App and delete all copies of the App from your devices. The provisions of this Agreement which by their nature should survive termination shall survive, including but not limited to sections 4, 5, and 9.
9. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the United States and the state in which you reside, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in your state of residence for any disputes arising out of or relating to this Agreement.
10. Changes to This Agreement
Licensor reserves the right to modify this Agreement at any time. When we do, we will revise the "Last updated" date at the top of this page. Your continued use of the App after any changes constitutes acceptance of the revised Agreement. If you do not agree to the revised terms, you must stop using the App.
